New Delhi, May 7: IT services firm Emphasis has filed a petition in a U.S. court, alleging that rival Coforge has violated contractual obligations by recruiting its former senior executive and obtaining sensitive customer information. This information has been reported by multiple sources.
Legal documents filed in March indicate that Emphasis is seeking to prevent Coforge from hiring two former officials linked to projects with Charles Schwab, a client served by both firms.
The company has also requested the court to halt any use of confidential business information allegedly acquired through these appointments.
Additionally, the lawsuit names Emphasis’s former Vice President, Brijesh Khergamkar, seeking to bar him from working on Charles Schwab’s outsourcing projects through Coforge for a year. Emphasis argues that such appointments breach the terms set in their previous contract.
Emphasis further claims that Coforge has gained an unfair business advantage by hiring several senior employees who had access to strategic and client-specific information.
In addition to seeking injunctive relief, the company is demanding legal costs, attorney fees, and economic damages.
Coforge has denied all allegations and reportedly intends to vigorously defend itself and its employees in this matter, while also assessing potential counterclaims.
Notably, similar disputes have emerged in the IT industry in recent years. In 2024, Infosys filed a counterclaim against Cognizant, alleging anti-competitive practices and executive recruitment. Earlier, in 2023, Wipro initiated legal action against former CFO Jatin Dalal after his move to Cognizant, citing alleged breaches of contractual commitments.
