Judge Recuses Himself from Hearing Tahir Hussains Bail Plea in Delhi Riots Case

New Delhi, June 1: Justice Amit Sharma has recused himself from hearing the regular bail plea of Tahir Hussain, an accused in the alleged major conspiracy related to the 2020 northeast Delhi riots. The hearing for Hussain’s bail application will now take place before a different bench on June 10.

Hussain has challenged the lower court’s decision to deny his bail in the Delhi High Court.

It is noteworthy that the court has previously taken a stringent stance on this matter. In January 2026, Hussain’s regular bail plea was also rejected. Following this, he filed a new application for interim relief on medical grounds.

On March 20, the court granted Hussain interim bail based on his health concerns. He cited the need for surgery due to an inguinal hernia and claimed that he required special care post-surgery.

The application stated that to prevent infection and ensure proper recovery, it was essential for him to remain outside of jail during the recovery period.

While hearing the interim bail plea, the court directed the Delhi government to ensure that Hussain’s hernia surgery is conducted within 15 days. The state government was also ordered to provide necessary medical care for Hussain at both the hospital and jail post-surgery.

It is important to mention that the riots in northeast Delhi in February 2020 resulted in the deaths of 53 individuals and left hundreds injured. The violence erupted during protests against the Citizenship Amendment Act (CAA). Investigating agencies have labeled it a premeditated conspiracy, with several individuals named as accused. Tahir Hussain is considered one of the main conspirators in this case.
