Delhi High Court Upholds Bail for Former Congress Councillor Ishrat Jahan in 2020 Riot Case

New Delhi, April 24: The Delhi High Court has upheld the bail granted to former Congress councillor Ishrat Jahan in connection with the 2020 Northeast Delhi riots. This decision came on Friday, rejecting a petition filed against her bail by the Delhi Police. Jahan had received regular bail from the Karkardooma Court on March 14, 2022.

The Delhi Police approached the High Court, seeking to revoke Jahan’s bail. However, a bench comprising Justice Naveen Chawla and Justice Ravinder Dudey refused to interfere with the bail granted to Jahan.

The bench noted that Jahan has been on bail for over four years, and there were no allegations of violating the conditions set by the trial court. The High Court clarified that it did not express any opinion on the merits of the case.

In its appeal, the Delhi Police argued that the trial court overlooked crucial evidence and made an error in granting bail. They claimed that a “pre-planned conspiracy” was orchestrated to incite large-scale violence during the visit of the then U.S. President to India.

The appeal also stated that the trial court’s order was against established legal principles and contained significant flaws. It alleged that Jahan played an active role in organizing protests that reportedly escalated into riots. However, the Delhi High Court dismissed these arguments on Friday and upheld the bail order.

In January 2024, a trial court framed charges against Ishrat Jahan and several others, including offenses such as rioting, unlawful assembly, and attempted murder. Additionally, in April 2024, a local court modified some of the conditions of Jahan’s bail, allowing her to practice law outside the National Capital Region (NCR).

It is noteworthy that the former Congress councillor was arrested in February 2020 in connection with a major conspiracy related to the riots.
