Punjab BJP Defends Chief Justice Appointment Amid AAP Criticism

Chandigarh, September 7 (Daily Kiran) : Punjab BJP President Keval Singh Dhillon has dismissed concerns raised by the Aam Aadmi Party (AAP) regarding the appointment of Justice Ashwini Kumar Mishra as the full-time Chief Justice of the Punjab and Haryana High Court. Speaking on Monday, Dhillon labeled the AAP’s questions as inappropriate.

In his statement, Dhillon emphasized that the entire process of appointing the Chief Justice adhered to constitutional guidelines and the established Memorandum of Procedure. He urged the need to understand the facts rather than politicizing the issue.

Dhillon explained that following a recommendation from the Supreme Court Collegium, the Punjab and Haryana governments were consulted on August 10 as part of the standard procedure. He noted that while the Haryana government and the governors of both states provided their consent, the Punjab government failed to respond within the specified timeframe.

According to Dhillon, if a government does not provide its opinion within the designated period, it is deemed to have given consent. Therefore, he argued that questioning the constitutional process at this stage is unreasonable.

He further accused the Punjab government of delaying important governmental files, which he claimed disrupts administrative and constitutional processes.

The BJP leader stated that unnecessary delays in matters related to the judiciary are not in the interest of effective institutional operation. He emphasized that respecting the independence of the judiciary and the constitutional process is a responsibility of every government. Dhillon condemned the Punjab Chief Minister and other ministers for questioning judicial independence, urging the state government to honor the constitutional process and established rules instead of creating political disputes.
