Rajasthan HC Extends Stay on FIR Against Shah Rukh Khan, Deepika Padukone in Car Marketing Case

Jaipur, September 25 (Patrika English News): The Rajasthan High Court has continued the stay on proceedings against actors Shah Rukh Khan and Deepika Padukone in connection with an FIR lodged at Mathura Gate police station, Bharatpur, over allegations of marketing a defective car.

Justice Sudesh Bansal, while hearing a criminal petition filed by the actors and others, directed that the matter be resolved amicably between the car company and the complainant.

Court’s Observations

During the hearing, the court questioned why the complainant had chosen to proceed against brand ambassadors when the issue primarily concerned the company. The bench observed that the dispute could be settled with the manufacturer and advised exploring a mutual resolution.

Arguments Presented

Senior advocates Vivek Raj Bajwa and Madhav Mitra, representing the petitioners, argued that:

  • The complainant had purchased the car in June 2022 for ₹23.97 lakh, used it for nearly three years and 67,000 km, and only then filed the FIR.

  • The actors had no direct role in the matter apart from being brand ambassadors.

  • Deepika Padukone became associated with the brand only after the complainant had purchased the vehicle.

  • A vehicle’s performance depends on usage, and if there were grievances, the matter should have been taken to a consumer forum rather than filed as a criminal case.

The defence further stated that despite the absence of any specific allegations against the actors, the Bharatpur lower court had directed registration of the FIR.

Background of the Case

Lawyer Kirti Singh had filed a complaint through a private application, leading to the FIR. The complaint alleged that:

  • The car failed to pick up speed while overtaking on highways, with only the RPM increasing.

  • A malfunction warning appeared on the odometer.

  • The car vibrated at higher speeds.

  • The dealership admitted it was a manufacturing defect.

The FIR named the company’s MD Unsoo Kim, Director and CEO Tarun Garg, along with Shah Rukh Khan, Deepika Padukone, and others as accused.

The High Court, in an earlier hearing, had already stayed further action in the case. The matter will now continue under judicial consideration.
