Jodhpur, September 16 (Patrika English News). The Rajasthan State Consumer Disputes Redressal Commission has dismissed the appeal of Tata AIA Life Insurance Company and directed it to pay the insured amount along with compensation and expenses to the complainant.

The commission, headed by President Devendra Kachhwaha and Member Liaqat Ali, ruled that if an insured person discloses details of at least one previously held policy while purchasing a new policy, failure to disclose other policies cannot be grounds to reject a claim.
Tata AIA was ordered to pay ₹3.5 crore (the policy amount) along with 9% interest from September 28, 2021, which totals around ₹1.25 crore in interest. Additionally, the company must pay ₹5 lakh as compensation and ₹25,000 towards litigation expenses to the complainant.
The case was filed by Anita Garg after the death of her husband Bharat Kumar, who had purchased a ₹3.5 crore policy from Tata AIA on January 27, 2020, in addition to an earlier ₹30 lakh policy from LIC. Bharat Kumar died in a road accident on October 28, 2020. The insurance company had rejected the claim on the grounds that he had not disclosed four other private policies.
The district commission in Balotra had earlier ruled in favour of the complainant, but Tata AIA appealed against the decision. The state commission upheld the district order, clarifying that disclosure of at least one prior policy is sufficient and that other policies, if taken later, cannot be used as a reason to deny the claim.
