
New Delhi, August 21: A lawyer named Sanket Gupta filed a complaint on Friday, demanding the registration of an FIR against Rahul Gandhi, the leader of the opposition in the Lok Sabha, along with Congress workers and supporters. They allegedly staged an unauthorized protest outside the Deputy Commissioner of Police (DCP) office at the Parliament Street police station.
The complaint cites Section 189 of the Indian Penal Code, 2023, as the basis for the FIR request. Rahul Gandhi was protesting against the police’s alleged refusal to register an FIR concerning a student who, according to Congress, was injured by pellet guns during a demonstration for educational reforms at Jantar Mantar last month.
Later in the evening, the Delhi police registered an FIR against unidentified individuals based on the complaint from the person allegedly injured by the pellet gun.
Speaking to reporters, Gupta stated, “Today, I went to the New Delhi district office of the Delhi police regarding an old complaint. I had some urgent work there, but I could not complete it. My clients were with me, but they also could not meet with the police officer. The reason was that there was a protest going on, with Rahul Gandhi and Congress workers creating a lot of noise, making the entire atmosphere very chaotic.”
He further added, “I have lodged a complaint with the Delhi police stating that if there is a protest, it should be conducted according to the law. No one has the right to take the law and the Constitution lightly while protesting.”
Citing a Supreme Court ruling, the lawyer emphasized, “The Supreme Court states that protests can be held, but rules and laws must be followed. No one can obstruct access to a police station with their movement. Rahul Gandhi gathered a crowd unlawfully, and I have filed a complaint demanding action against him.”
Gupta reiterated that an FIR should be registered against anyone violating public order. He stated, “According to the applicable legal provisions, no gathering of more than five people is allowed in this sensitive area of New Delhi. Blocking the gate of the DCP office for political interests, where urgent complaints may arise, is entirely wrong. That is why I have filed a complaint against Rahul Gandhi.”
