
New Delhi: The Delhi High Court is scheduled to hear petitions filed by Rashtriya Janata Dal chief Lalu Prasad Yadav and his family members on Tuesday. These petitions challenge the trial court’s order directing framing of criminal charges against them in the IRCTC hotel scam case.
According to the cause list published on the Delhi High Court’s official website, the matters are listed before a single-judge bench of Justice Swarna Kanta Sharma on January 27. Criminal revision petitions have been filed by Lalu Prasad Yadav, his wife Rabri Devi, and son Tejashwi Yadav against the trial court’s order to frame charges relating to corruption, criminal conspiracy, and cheating in the IRCTC hotel scam case.
Earlier, the Delhi High Court had issued a notice to the Central Bureau of Investigation (CBI) on applications filed by Rabri Devi and Tejashwi Yadav seeking a stay on the trial court proceedings. While issuing the notice, Justice Sharma stated that the petitions filed by Lalu Prasad Yadav would be heard alongside these matters.
In her petition, Rabri Devi contended that the trial court wrongly framed charges against her based on conjectures without properly appreciating the evidence on record. Similarly, Tejashwi Yadav challenged the validity and correctness of the trial court’s order, arguing that the prosecution had failed to make a prima facie case warranting framing of charges.
The trial court order dated October 13, 2025, by Special Judge Vishal Gogne at Rouse Avenue Court, paved the way for trial against Lalu Prasad Yadav, Rabri Devi, Tejashwi Yadav, and other accused under sections 420 (cheating) and 120B (criminal conspiracy) of the Indian Penal Code, along with provisions of the Prevention of Corruption Act, after they denied the charges.
Following detailed arguments on framing of charges against Lalu Prasad Yadav, his family members, Prem Gupta, Sarla Gupta, and railway officials Rakesh Saxena and P.K. Goyal, the special court reserved its order on May 29.
The scam relates to the period between 2004 and 2009 when Lalu Prasad Yadav was the Railway Minister. During his tenure, two IRCTC hotels were allegedly leased out without following prescribed rules. One of these hotels was allotted to Sarla Gupta, wife of Prem Gupta, a close associate of the RJD chief and then Rajya Sabha member.
