New Delhi, August 24: The Supreme Court has reinstated the election petition filed by Congress leader Hafiz Rashid Ahmed Chaudhary against BJP MP Kripanath Mallah. This decision was made on Monday after the Guwahati High Court had dismissed the petition earlier.
A bench comprising Justice JB Pardiwala and Justice K Vinod Chandran accepted the appeal, stating, “We have approved the appeal based on the previous decision of the constitutional bench.”
With the election petition reinstated, the Guwahati High Court will now conduct a fresh hearing on the matter. Hafiz Rashid Ahmed Chaudhary had alleged corrupt practices against the winning candidate, who secured victory by a margin of 18,360 votes.
Previously, in April 2025, the Guwahati High Court had dismissed the petition due to procedural deficiencies. Questions were raised regarding the presentation of the petition and the authentication of documents by Mallah’s side.
In the original election petition, the Congress leader accused the winning candidate of irregularities in the voting process, including booth capturing at 47 polling stations. He also claimed discrepancies in voter turnout and counting figures.
Hafiz Rashid Ahmed Chaudhary contested the 2024 parliamentary elections against Kripanath Mallah from the Karimganj constituency on a Congress ticket. In this election, Hafiz Rashid received a total of 526,733 votes, while Kripanath Mallah, as the BJP candidate, garnered 545,093 votes, resulting in a margin of 18,360 votes.
The third position was held by Sahabul Islam Chaudhary from the All India United Democratic Front (AIUDF), who received 29,205 votes.
