Rajasthan HC Rules No NOC Needed for Electricity Connection

Jodhpur, 09 December (Daily Kiran) – The Rajasthan High Court has delivered a significant judgment regarding electricity connections. The court stated that no person requires a No Objection Certificate (NOC) or clear ownership proof from co-owners to obtain an electricity connection.

Justice Dr. Nupur Bhati’s bench, after hearing the petition of Usha Kalla, a resident of Shastri Nagar, directed Jodhpur Discom to restore electricity supply at her residence. The court clarified that under Section 43 of the Indian Electricity Act, 2003, a person living in a house has the right to an electricity connection.

The petitioner, Usha Kalla, has been residing at house number G-100 in Shastri Nagar since 1999. The late Shambhu Datt Kalla held the house lease since 1969 and had distributed the property among his wife, the petitioner, and their children through a will dated 14 September 2017 before his death in 2019.

On 15 July 2025, Discom disconnected the petitioner’s electricity connection. Her lawyer argued in court that she was peacefully residing in the house when the connection was cut due to a dispute. Despite completing all formalities to restore the connection, Discom rejected the application on 15 September, stating that the petitioner must obtain NOC from other co-owners.

The lawyer contended that as per Section 43 of the Indian Electricity Act, 2003, Discom is obligated to provide electricity on the application of the house owner or tenant. He argued that Discom rejected the application arbitrarily.

Tenant Can Also Apply

The court analyzed Section 43 and observed that an application for electricity supply can be made by either the owner or the tenant of the house. It further clarified that the petitioner is not required to provide documentary evidence of exclusive or undisputed ownership of the entire property or any part of it.

The court added that the petitioner need not produce consent from registered co-owners or obtain any directive from a competent court to secure the electricity connection. It set aside the 15 September 2025 order and directed Discom to restore electricity supply at the petitioner’s residence, provided the application complies with all mandatory aspects under Section 43.
