Jaipur, August 14 (Kiran News): The Rajasthan High Court has questioned the state government over the legal basis for directing nearly 40,000 private schools in the state to grant admissions under the Right to Education (RTE) Act at pre-primary entry levels, including PP-3, PP-4, PP-5, and Class 1. The court has also asked why the government will not reimburse the fees for these admissions.
Hearing a joint set of appeals filed by the state government and private schools, a division bench comprising Justice Avneesh Jhingan and Justice Baljinder Singh Sandhu directed the state to present a clarification from the competent authority. The matter has been listed for further hearing on August 19.

Appeals Against Single Bench Order
Advocates Prateek Kasliwal and Dr. Abhinav Sharma informed the court that the appeals challenge the single bench order dated July 18, 2023, which directed private schools to admit children at pre-primary entry levels, i.e., nursery, as well as Class 1, for the 2023–24 academic session.
The state government has also appealed against the single bench decision that struck down its provision denying reimbursement of fees for admissions to pre-primary classes under RTE. Additionally, the state has challenged the directive to allow admissions at only nursery and Class 1 levels instead of four levels as initially instructed.
