Supreme Court to Hear EDs Petition on West Bengal Government Interference

New Delhi, February 10: The Supreme Court will hear a petition filed by the Enforcement Directorate (ED) on Tuesday. The petition alleges that the West Bengal government and Chief Minister Mamata Banerjee interfered during searches conducted by the central agency at the Kolkata office of IPAC and the residence of its co-founder, Pratik Jain.

According to the case list published on the Supreme Court’s website, the matter is scheduled to be heard by a bench comprising Justices Prashant Kumar Mishra and Sandeep Mehta.

Last week, Solicitor General Tushar Mehta, representing the ED, requested time to respond to the counter-affidavit submitted by the West Bengal government, leading to a postponement of the hearing. Accepting the request, the bench led by Justice Mishra adjourned the case until February 10.

In its petition, the ED has sought directions to file an FIR against Chief Minister Mamata Banerjee, the state’s Director General of Police (DGP), and the Kolkata Police Commissioner. The allegations state that they obstructed the federal agency during simultaneous search operations.

In her counter-affidavit, Chief Minister Banerjee denied all allegations of interference and obstruction, asserting that her limited presence at the premises was solely to retrieve sensitive and proprietary data related to her party, the All India Trinamool Congress (AITC).

The affidavit states that Banerjee visited Pratik Jain’s residence on Loudon Street and the IPAC office in Bidhannagar on January 8, 2026, upon learning that sensitive political data of the Trinamool Congress was being accessed during the searches.

She emphasized that this data was crucial for the AITC’s strategy for the upcoming assembly elections.

The affidavit further claims that upon arriving at the premises, she politely requested the ED officials to allow her to retrieve party data, including stored devices and files containing copies.

It is also claimed that the ED officials present did not object to this request and permitted her to take some devices and files.
