
Gandhinagar, March 27: Gujarat Chief Minister Bhupendra Patel announced on Friday a significant reduction in stamp duty for transactions involving inherited agricultural land. The deadline for farmers to obtain ownership rights has also been extended.
These measures aim to alleviate legal processes and financial pressures in rural areas. The state government has decided to impose a nominal stamp fee of ₹300 on certain transactions related to inherited agricultural land, providing relief from existing market-based stamp duty provisions.
This decision applies to internal land transactions among heirs, including direct descendants and, in their absence, indirect heirs. Under the revised provisions, if one or more heirs among jointly registered holders relinquish their rights in favor of one or more other heirs, a stamp duty of ₹300 will be applicable for each relinquishment.
Similarly, if one or more heirs are recorded in the rights document in one or more stages, a stamp fee of ₹300 will apply for each entry involving indirect heirs. In cases where jointly registered holders divide inherited property over time, including direct or indirect descendants, a stamp fee of ₹300 will be charged for each division deed.
This rate will also apply in cases where only indirect descendants are involved, and no direct descendants are alive. This includes relinquishment of rights, registration of names or rights during a lifetime, and division, with the specified fee applicable for each document.
The Chief Minister stated that this decision was made following representations from community leaders and farmer organizations. He emphasized that by relieving the burden of market-based stamp duty provisions, the state government aims to reduce financial pressures on farmers and facilitate transactions related to inherited land.
Furthermore, he noted that simplifying property distribution among family members would help reduce disputes and litigation. Officials indicated that this initiative is expected to encourage the formal documentation of transactions that often go unregistered due to high stamp duties, thereby improving legal clarity.
