Delhi Govt Announces Special Amnesty for Prisoners on Republic Day

The Delhi Government has decided to grant special amnesty to eligible prisoners on the occasion of Republic Day, 26 January. Ashish Sood, Delhi’s Home Minister, informed that this pardon will apply to convicted prisoners sentenced by criminal courts in Delhi.

Prisoners serving sentences either in central jails in Delhi or outside the city will be released on 26 January, subject to meeting specified conditions.

Age-wise and Sentence-wise Amnesty Details

For prisoners aged 65 and above, the amnesty will be granted as follows: those sentenced to more than 10 years will receive a remission of 90 days; prisoners with sentences between 5 and 10 years will get 60 days remission; those sentenced between 1 and 5 years will get 30 days; and prisoners with sentences up to 1 year will receive 20 days remission.

For other prisoners, the remission limits will differ: 60 days for sentences exceeding 10 years, 45 days for sentences between 5 and 10 years, 30 days for sentences between 1 and 5 years, and 15 days for sentences up to 1 year.

Additional Conditions and Exclusions

This special amnesty is over and above the remission already granted under the Delhi Jail Rules, 2018. Convicted prisoners on parole or furlough on Republic Day will also be eligible, provided they have not committed any misconduct during the relevant period.

Only those prisoners who have not been convicted of any jail offense during the one-year period from 26 January 2025 to 25 January 2026 will be eligible for this benefit.

However, certain categories of prisoners are excluded from this special amnesty. These include those sentenced to death or those whose death penalty has been commuted to life imprisonment, detainees, civil prisoners, prisoners incarcerated for avoiding government dues, and those convicted under the NDPS Act, POCSO Act, Official Secrets Act, espionage-related offenses, court-martial convictions, contempt of court, crimes against women under the Indian Penal Code (IPC), and certain specified civil offenses.

Additionally, cases falling under ‘exception’ categories notified by the Home Ministry, especially those related to offences listed in the Seventh Schedule, List-1 of the Constitution, will not be covered under this remission.

Commitment to Reformatory Justice and Public Safety

The Home Minister emphasized that the Delhi Government remains committed to the principles of reformatory justice. At the same time, it is determined to ensure strict adherence to public safety and constitutional as well as legal provisions.

This special amnesty reflects the government’s balanced approach towards correctional reforms and public security on the occasion of the 77th Republic Day.
