
Kolkata, April 5: The West Bengal BJP has lodged a formal complaint with the Election Commission against Trinamool Congress (TMC) MP Kalyan Banerjee. The BJP alleges that Banerjee made incendiary, derogatory, and hate-filled statements against Union Home Minister Amit Shah and BJP leaders/supporters, violating the Model Code of Conduct during the assembly elections.
The complaint states that Banerjee’s remarks have spread widely in the public domain and include abusive language and provocative comments.
The BJP argues that this is not an isolated incident but part of a pattern of escalating incendiary rhetoric from TMC leaders. These statements aim to create tension, hatred, and polarization in the electoral atmosphere.
The letter also notes that such repeated statements from TMC leaders are intended to damage the reputation of the BJP and interfere with the electoral process. The BJP claims these remarks are made under the approval and direction of party leadership, indicating a systematic and institutional violation of the Model Code of Conduct.
According to the BJP, these statements incite unrest and fear among the public, potentially disrupting the electoral balance. They referenced two sections of the Model Code of Conduct, stating that no political party or candidate should engage in activities that foster mutual hatred or communal tensions. Criticism should remain limited to policies and programs, not personal attacks.
The letter further asserts that Kalyan Banerjee’s statements fall under the category of offenses as defined by Sections 352 and 353 of the Indian Penal Code, 2023. Additionally, it could negatively impact electoral rights under Section 171C of the Representation of the People Act, 1951.
The BJP has urged the Election Commission to investigate this matter seriously and take necessary action against the TMC MP’s incendiary remarks to ensure that the 2026 assembly elections are conducted fairly, peacefully, and democratically.
