Andhra Pradesh Polices Controversial Arrest Attempt in Patna Raises Legal Concerns

Patna, February 24: The Andhra Pradesh Police became a topic of discussion in Bihar’s capital, Patna, on Monday. They arrived to arrest Indian Police Service officer M. Sunil Nayak without a warrant. Meanwhile, the Patna Civil Court rejected the transit remand application from the Andhra Pradesh Police.

The court found that the Andhra Police did not follow the proper procedures, leading to the denial of the remand. Patna Police stated that while the matter is judicial, the rules were not adhered to.

Central Superintendent of Police Bhanu Pratap from Patna stated that the Andhra Pradesh Police arrived without a warrant for the arrest. Upon their arrival, they sought assistance from local police. However, when the case was presented in court, the judge refused the transit remand.

Reportedly, when the Andhra Pradesh Police attempted to arrest Nayak, who is the Inspector General of Bihar Home Guards and Fire Services, he also sought the court’s intervention. After hearing the case, the court clarified that the Andhra Pradesh Police lacked a valid arrest warrant and an updated case diary, expressing dissatisfaction with their approach.

Nayak’s lawyer, Amit Srivastava, accused the Andhra Police of ignoring legal protocols. He stated that they would challenge this action in court soon. The court also directed that the Andhra Pradesh Police should not undertake any lawful punitive action for the next 30 days.

The court explicitly mentioned several rulings, stating that they could not legally grant the transit remand. Legal action will be taken against the Andhra Pradesh Police, as they were in Patna to arrest in connection with a case from Guntur district.
