
New Delhi, July 15: The Supreme Court has declined to hear a petition seeking a CBI investigation into the alleged encounter of Bharat Bhushan Tiwari in Bihar’s Bhojpur district. The court directed the petitioner to approach the Patna High Court instead. Following this decision, the petitioner’s lawyer, Narendra Mishra, expressed concerns about the court’s ruling and stated that they would pursue further legal action in the Patna High Court.
In an interview, Mishra explained that he had initially requested the Supreme Court to take suo motu cognizance of the case. Subsequently, he received guidance from the office of the Chief Justice of India (CJI) to file a writ petition, which he did. However, the Supreme Court advised him to take the matter to the Patna High Court.
Mishra noted, “The family of Bharat Bhushan Tiwari has been in constant touch with us, demanding justice in this case.” He added, “Our petition included five key demands, the most crucial being that the entire investigation should be conducted under the supervision of a committee formed by a current judge of the Supreme Court, as there seems to be little hope for a fair investigation at the state level.”
He alleged, “No police encounter can occur without the knowledge and permission of senior officials. Therefore, there should be an impartial investigation into the role of the concerned senior officials. Multiple FIRs have been filed in this case, and many individuals are facing action, leaving no one to voice the concerns of the affected parties.”
The lawyer also mentioned that several significant encounters have taken place in Bihar over the past 70 days, and he intended to present this list before the court. He referenced previous Supreme Court rulings, emphasizing that the law does not permit any agency to conduct fake encounters, and a fair investigation into such cases is essential.
Mishra further alleged, “If the police themselves consider any action to be wrongful or fake, then the relevant officials should be prosecuted under serious charges, including murder.”
He stated that he would write to the Chief Justice to inform them of the entire situation and would proceed with legal actions based on the directives from the Patna High Court.
