Supreme Court Denies CBI Inquiry in Bharat Tiwari Encounter Case

New Delhi, July 15: The Supreme Court has declined to hear a petition seeking a CBI investigation into the alleged encounter of Bharat Bhushan Tiwari in Bhojpur district, Bihar. The court directed the petitioner to approach the Patna High Court instead. Following this decision, the petitioner’s lawyer, Narendra Mishra, raised concerns about the court’s ruling, stating that they would pursue further legal action in the Patna High Court.

In an interview, Mishra explained that he initially requested the Supreme Court to take suo motu cognizance of the case. Subsequently, he received instructions from the office of the Chief Justice of India (CJI) to file a writ petition, which he did. However, the Supreme Court refused to hear the case and advised him to take it to the Patna High Court.

Mishra noted, “The family of Bharat Bhushan Tiwari has been in constant contact with us, demanding justice in this matter.” He added, “Our petition included five key demands, the most significant being that the entire case be investigated by a committee under the supervision of a current Supreme Court judge, as there seems to be little hope for a fair investigation at the state level.”

He alleged, “No police encounter can occur without the knowledge and permission of senior officials. Therefore, there should also be a fair investigation into the roles of the relevant senior officials. Multiple FIRs have been filed in this case, and numerous individuals are facing action, leaving no voice for the affected parties.”

The lawyer also mentioned that several major encounters have taken place in Bihar over the past 70 days, a list of which he intended to present to the court. He referenced previous Supreme Court decisions, emphasizing that the law does not permit any agency to conduct fake encounters, and that a fair investigation into such cases is essential.

Mishra further alleged, “If the police themselves consider any action to be wrongful or fake, then serious charges, including murder, should be filed against the concerned officials.”

He stated that he would write to the Chief Justice to inform them of the entire situation and will proceed with further legal actions based on the directives of the Patna High Court.
