New Delhi, June 10: The Delhi High Court held a hearing on Wednesday regarding the alleged major conspiracy linked to the riots in Northeast Delhi. The court has directed the Delhi Police to respond to the petition filed by accused and former councillor Tahir Hussain. The next hearing is scheduled for July 16.
Tahir Hussain has challenged the lower court’s order that rejected his bail plea under the Unlawful Activities (Prevention) Act (UAPA). He filed an appeal against the order issued by the special court on January 29.
During the hearing, the High Court specifically requested the Delhi Police to respond to Hussain’s application, which seeks to excuse the 67-day delay in filing the appeal. Hussain argues that certain circumstances prevented him from submitting the appeal within the stipulated timeframe, and therefore, the delay should be pardoned in the interest of justice.
The court has asked the Delhi Police to present their stance on this application. The police must clarify their position regarding the request to excuse the delay and whether they wish to raise any objections against it.
In the investigation related to the Delhi riots, the police alleged that a widespread conspiracy was orchestrated behind the communal riots that occurred in February 2020. Various sections, including the UAPA, have been invoked in this case. Chargesheets have already been filed against several accused individuals, and the trial proceedings are ongoing.
Tahir Hussain has been in judicial custody for an extended period and has approached the courts in various matters. Previously, the special court denied his bail plea, stating that the evidence on record prima facie indicates serious charges against him. Following this, he approached the High Court.
