Central Government Requests Deputation of Darjeeling DM and Siliguri CP Amid Protocol Controversy

Kolkata, March 14: The central government has requested the deputation of a District Magistrate (DM) and a Commissioner of Police (CP) from West Bengal’s Darjeeling district following a recent protocol breach during President Droupadi Murmu’s visit to an international Santhal conference.

The officials involved are Manish Mishra, the current District Magistrate of Darjeeling, and C. Sudhakar, the Commissioner of the Siliguri Metropolitan Police.

According to an insider from the Secretariat, a message regarding this matter was sent from the Ministry of Home Affairs to the state Secretariat ‘Nabanna’ last Friday.

The state government has already relieved Mishra from his position as District Magistrate. Sunil Agarwal, the former Special Secretary of the North Bengal Development Department, has taken over as the new District Magistrate.

As per regulations, since the President is the constitutional head of the country, any negligence regarding her security or protocol allows the central government to call officials for central deputation, regardless of any objections from the state government.

The Supreme Court has upheld the validity of Rule 6(1) of the IPS (Cadre) Rules, 1954. This rule grants the central government the authority to overturn state government decisions regarding the transfer and deputation of IPS officers if necessary. If a state government refuses to release an officer for central deputation, that officer can be barred from such postings for up to five years.

Such incidents can hinder the career growth of the concerned IPS officer, as a minimum of two years of central deputation is mandatory for officers from the 2011 batch or later to be eligible for inclusion in the panel for the rank of Inspector General.

President Murmu attended the international Santhal conference in Siliguri on March 7. However, complaints of protocol violations arose during her visit, and even the President expressed mild displeasure regarding the matter. Allegations were also made concerning the failure to adhere to security protocols.
