New Delhi, April 15: Congress leader Pawan Khera has encountered a significant setback from the Supreme Court. This issue pertains to the transit anticipatory bail he received from the Telangana High Court, which is now under scrutiny by the country’s highest court following an FIR filed against him by the Assam government.
The controversy began when Khera made serious allegations against Assam Chief Minister Himanta Biswa Sarma and his wife, Riniki Bhuyan Sarma. In response, a case was registered against Khera in Assam. To avoid arrest, he petitioned the Telangana High Court for transit anticipatory bail, which initially granted him some relief. However, the Assam government objected to this decision and challenged it in the Supreme Court.
The Supreme Court hearing was conducted by a bench comprising Justice J.K. Maheshwari and Justice Atul S. Chandurkar. During the proceedings, Solicitor General Tushar Mehta, representing the Assam government, argued that the FIR was registered in Assam, questioning how the Telangana High Court could grant anticipatory bail. He pointed out that Khera’s wife resides in Delhi, and Khera occasionally travels, raising concerns about jurisdiction based solely on property ownership.
The Solicitor General further contended that the appropriate forum for such matters should have been the Assam High Court, not the Telangana High Court. Based on this argument, the Assam government requested the Supreme Court to annul the Telangana High Court’s decision. The Supreme Court took this argument seriously, issuing a notice to Pawan Khera and demanding a response within three weeks. The court also indicated that if Khera seeks anticipatory bail, he should approach the Guwahati High Court.
