Legal Challenge to Caste Certificate Re-Verification in West Bengal

Kolkata, June 19: The Communist Party of India (Marxist-Leninist) Liberation has filed a Public Interest Litigation (PIL) in the Calcutta High Court, challenging the West Bengal government’s decision to re-verify all caste certificates issued over the past 15 years for Scheduled Castes (SC), Scheduled Tribes (ST), and Other Backward Classes (OBC).

The petition was filed by state secretary Abhijit Majumdar and state committee member Malay Tiwari on behalf of the party.

In its statement, CPI(ML) Liberation accused the BJP government of attempting to undermine reservation rights by implementing a new “Special Intensive Review” (SIR) process after completing a previous review aimed at disenfranchising voters.

The party contended that instead of effectively enforcing the existing system to check fraudulent caste certificates, genuine SC, ST, and OBC citizens are facing scrutiny and harassment.

The statement also claimed that this process aims to weaken the identity and constitutional rights of the new generation of Dalit, tribal, and marginalized communities.

CPI(ML) further asserted that linking an individual’s inclusion or exclusion in the SIR to the verification of caste certificates is entirely illegal.

The party has initiated this legal battle to protect the interests of Dalit, tribal, and marginalized communities, pledging to continue its efforts. Additionally, the West Bengal state committee has called for a widespread public campaign and movement at all societal levels to safeguard these rights.
