Hearing on Rabri Devi’s Petition at Rouse Avenue Court on December 9

New Delhi, 6 December (Daily Kiran) – The Principal and District Judge of Rouse Avenue Court in Delhi has ordered the continuation of the hearing on December 9 regarding the petition filed by former Bihar Chief Minister Rabri Devi. The petition requests the transfer of her pending cases and those against her family members to another judge. These cases are related to two railway scams. Judge Dinesh Bhatt issued this order.

During the hearing on Saturday, Rabri Devi’s lawyer alleged that the presiding judge, Vishal Gogne, was not following proper procedures and intended to deliver a verdict by 2026. The lawyer also accused Judge Gogne of summoning the court during the Bihar Assembly elections while framing charges.

Rabri Devi’s petition seeks to transfer the cases from Judge Vishal Gogne to another judge. She has accused Judge Gogne of being biased against her and deliberately advancing the cases in a prejudiced manner. The petition covers four pending cases, including the railway tender scam and the land-for-jobs scam cases, which are currently with Judge Gogne. On October 13, Judge Gogne framed charges against accused Lalu Yadav, Rabri Devi, and Tejashwi Yadav in the railway tender scam case.

The petition states that Judge Gogne is hearing the cases with a fixed mindset against Rabri Devi and her family members. It claims that his conduct appears to support the prosecution rather than acting as an impartial judge. Therefore, the petition requests that the trials in the four cases be transferred to an independent judge.

On October 13, the court framed charges against Lalu Yadav, Rabri Devi, and Tejashwi Yadav under Sections 428, 120B of the Indian Penal Code and Section 13(2) of the Prevention of Corruption Act in connection with the CBI’s railway tender scam case. When asked, the accused denied the charges and said they would face the trial.

The CBI had stated on February 28 that it had solid evidence to prosecute the accused in the railway tender scam. On January 28, 2019, the court granted regular bail to Lalu Yadav, Rabri Devi, and Tejashwi Yadav in the Enforcement Directorate’s case on a personal bond of Rs. 1 lakh each. Earlier, on January 19, 2019, Lalu Yadav was granted regular bail in the CBI case.

The court had taken cognizance of the Enforcement Directorate’s chargesheet on September 17, 2018. The ED had named several accused in the case, including Lalu Prasad, Rabri Devi, Tejashwi Yadav, Lara Project LLP, Sarla Gupta, Premchand Gupta, Gaurav Gupta, Nathmal Kakraniya, Rahul Yadav, Vijay Tripathi, Devkinandan Tulsiyan, Sujata Hotel, Vinay Kochar, Vijay Kochar, Rajiv Kumar Relan, and Abhishek Finance Private Limited.
