
New Delhi, February 21: A court in New Delhi will hear a petition against Sonia Gandhi, the Chairperson of the Congress Parliamentary Party, on Saturday. The petition alleges that her name was fraudulently included in the voter list before she obtained Indian citizenship.
The petition, filed by lawyer Vikas Tripathi, challenges the order issued by Additional Chief Metropolitan Magistrate Vaibhav Chaurasia on September 11, 2025. The magistrate had dismissed a complaint seeking a police investigation into the alleged wrongful inclusion of Sonia Gandhi’s name in the voter list.
According to the petitioner, Sonia Gandhi’s name first appeared in the voter list for the New Delhi constituency in 1980, nearly three years before she officially received Indian citizenship in April 1983. The petition claims that such an entry could not have been made without forged or fabricated documents, constituting a cognizable offense.
It is also noted that Sonia Gandhi’s name was removed from the voter list in 1982 and was reinstated after she became an Indian citizen in 1983, raising questions about the legal validity of her earlier entry.
On December 9, 2025, a special judge at Rouse Avenue Court, Vishal Gogne, agreed to consider the petition and issued notices to both Sonia Gandhi and the Delhi Police, directing the case to be listed for further hearing.
Previously, the magistrate’s court had rejected the complaint seeking the registration of an FIR, stating that the judiciary cannot initiate investigations that would unnecessarily interfere with areas assigned to constitutional authorities. The court emphasized that such interference would be prohibited under Article 329 of the Constitution, which limits judicial involvement in electoral matters to election petitions.
However, Sonia Gandhi has dismissed the allegations. In response to the petition, she stated that the accusations against her are politically motivated and based on false and misleading facts.
In her reply, she argued that questions related to citizenship fall solely within the jurisdiction of the central government, while disputes concerning the voter list are under the purview of the Election Commission. She further contended that no credible documentary evidence has been presented to substantiate the claims of forgery or fraud.
