
New Delhi, February 19: The Supreme Court has announced a new hearing date for the petitions challenging the Citizenship Amendment Act (CAA). The court stated that hearings will commence on May 5, 2026. The Chief Justice clarified that cases related to Assam and Tripura will be heard separately, while all other cases from across the country will be addressed first.
Currently, there are a total of 237 petitions pending in the Supreme Court against the CAA. These petitions argue that the law discriminates on religious grounds, particularly against the Muslim community. Petitioners claim that the central government should not have implemented this law. The rules for the CAA were notified by the central government on March 11, 2024, which led to the filing of additional petitions.
During the proceedings, the Chief Justice emphasized the need to set a clear date for the hearings. He suggested that petitioners be allotted a full day to present their arguments. The court also mentioned that any party wishing to submit additional documents or supplementary arguments could do so.
Solicitor General Tushar Mehta reminded the court of an order passed on January 22, 2020, which instructed the categorization of cases into two groups. Cases related to Assam and Tripura were to be listed together, while the remaining cases from the rest of the country would be handled separately. The Chief Justice agreed, stating that cases from across the country would be heard first, followed by those from Assam and Tripura.
The CAA was passed by Parliament in 2019, providing a pathway to Indian citizenship for non-Muslim refugees from Pakistan, Bangladesh, and Afghanistan. Opposition parties and various organizations have labeled it unconstitutional and discriminatory. The matter has been pending in the Supreme Court for an extended period, with a final decision yet to be reached.
