Supreme Court Refuses to Hear Petition Against Assam CM Himanta Biswa Sarma

New Delhi, February 16: The Supreme Court declined to hear a petition seeking action against Assam Chief Minister Himanta Biswa Sarma on Monday. The petitions were filed by CPI(M), CPI leader Annie Raja, and Assamese scholar Hiren Gohain.

A bench comprising Chief Justice of India (CJI) D.Y. Chandrachud, Justice Joymalya Bagchi, and Justice Vipul Pancholi directed the petitioners to approach the High Court.

The court stated, “All these issues can be effectively adjudicated by the High Court, which has jurisdiction. We see no reason to hear this matter here, and therefore, we send the petitioners to the competent High Court. We request the Chief Justice of the High Court to prioritize the hearing, as the lawyer cited urgency in the matter.”

Petitioner’s lawyer Abhishek Manu Singhvi argued that Sarma has made statements not only in Assam but also in Jharkhand and Chhattisgarh, warranting Supreme Court attention. Singhvi contended that a Chief Minister, who has taken an oath to uphold the Constitution, is a constitutional authority and has violated that oath.

The petitions referenced Sarma’s controversial “Miya Muslim” statement and called for the registration of an FIR and an SIT investigation based on a viral video on social media.

The court clarified that while it has the authority to hear the case directly, it is not in favor of taking shortcuts.

CJI Chandrachud remarked, “We have pending cases that need resolution. There seems to be a deliberate attempt to undermine the High Court. You have not approached the High Court yet. We trust that the High Court can consider and decide on this matter.” The court emphasized that the High Court should first handle the case, and it is fully prepared to do so.
