Jaipur, August 25: The Family Court in Rajasthan’s Jaipur has annulled a nearly three-year-old unilateral divorce decree involving former BJP legislator Amrita Meghwal and Babulal Meghwal, the district president of the BJP’s SC Morcha. The court determined that Amrita Meghwal had not received proper notice as per legal requirements and was not given a fair opportunity to present her case.
Presiding officer Amar Verma accepted Amrita Meghwal’s application and revoked both the unilateral proceedings from May 4, 2023, and the divorce decree issued on June 7, 2023. The court has reinstated the case for further hearings.
Babulal Meghwal had filed for divorce under Section 13 of the Hindu Marriage Act on September 22, 2022. Notices were sent to Amrita Meghwal’s old address in Jaipur, but they were returned multiple times as the house had been unoccupied for a long time. Consequently, a notice was published in a newspaper to fulfill the service requirement.
In court, Amrita Meghwal stated that she did not reside at that address and was unaware of the divorce proceedings. Upon learning of the case, she requested a copy on June 13, 2023, and filed an application to annul the unilateral decree on July 5, 2023.
After reviewing the records, the court acknowledged that the house at the address where notices were sent was closed, and registered mail was returned with the same note. Thus, the newspaper notice alone was deemed insufficient for proper service.
Following the court’s order, the divorce case will be heard again, allowing both parties to present their arguments. Amrita Meghwal was represented by attorney Sanjay Borana, while Babulal Meghwal was represented by attorney Surendra Kumar Dave.
Amrita Meghwal expressed that incorrect facts were presented to the court, leading to the unilateral decision. The court’s recent ruling has provided her with relief.
On the other hand, Babulal Meghwal stated that this is not a final decision but part of the legal process. He mentioned that the court would allow Amrita Meghwal to present her case in the upcoming hearings. Babulal added, “Even if Amrita is a precious gem, I no longer wish to keep this gem.”
Amrita and Babulal Meghwal were married on April 21, 2008. Amrita hails from Chanod in Pali district, while Babulal is from Norwa village in Jalore district. They began living separately after a dispute on January 21, 2019. Nearly three years later, Babulal filed for divorce in Family Court, which resulted in a unilateral decree in June 2023. This decree has now been annulled.
