Petition Filed in Supreme Court Against Congress Over Comments on CJI Suryakant

New Delhi, October 13 (Daily Kiran) : A petition has been filed in the Supreme Court demanding criminal contempt proceedings against the Congress party following comments made about Chief Justice Suryakant on social media. The petition, submitted by a group of lawyers, calls for guidelines to prevent political parties from launching public campaigns targeting judges and the Chief Justice.

This legal action comes after a post from the official Twitter account of the Congress party’s Kerala unit on October 12, which directly addressed CJI Suryakant, stating, “Dear Suryakant, if maintaining law and order is not your responsibility, then resign now. We can find someone else to handle it.”

On the same day, Trinamool Congress MP Mahua Moitra also made a post on social media. The petition argues that Congress’s post referred to the Chief Justice by name instead of using a respectful title associated with his position. The petitioners allege that such comments exert pressure on a sitting Chief Justice and aim to influence him.

The petitioners contend that demanding the resignation of the Chief Justice and suggesting the appointment of another individual is contrary to constitutional norms. Citing Articles 121 and 124(4) of the Constitution, the petition emphasizes that there is a prescribed procedure for the removal of Supreme Court judges.

Furthermore, the petitioners express concern that public campaigns aimed at pressuring or influencing a judge jeopardize judicial independence. The central government, Congress party, Rahul Gandhi, Mallikarjun Kharge, the Kerala Pradesh Congress Committee, Mahua Moitra, and Akhilesh Yadav have all been named as parties in this case.
