Manish Sisodia Chooses Satyagraha, Writes to Justice Swarnkant Sharma

New Delhi, April 28: Senior leader of the Aam Aadmi Party, Manish Sisodia, has written to Justice Swarnkant Sharma of the Delhi High Court, stating that he will not participate in the upcoming hearings of his case. He expressed that his conscience does not permit him to engage in the matter under the current circumstances.

In a post on ‘X’, Sisodia emphasized that this is not a personal issue but a matter of trust in the justice system. Every citizen deserves not only fair justice but also the appearance of fairness.

He clarified that he has complete faith in the judiciary and the Constitution. However, when serious doubts arise, it does not feel right to formally participate. For this reason, he has chosen the path of ‘satyagraha’.

In his letter, Sisodia mentioned that this decision was made after careful consideration and is in no way a disrespect to the court or the judge. On April 27, Arvind Kejriwal also wrote a letter regarding the same issue, declining to participate in further proceedings. Sisodia stated that he read Kejriwal’s letter attentively and agreed with the concerns raised.

Sisodia highlighted two main concerns in his letter. First, Justice Swarnkant Sharma’s public participation in events organized by the All India Bar Association. Second, the professional involvement of her children with various panels of the central government. Sisodia noted that this creates the perception of a potential closeness between legal authorities and opposing parties.

He also pointed out the role of Solicitor General Tushar Mehta in this context, as Sisodia claims that the judge’s children’s professional matters have been influenced by him.

Sisodia made it clear that he is not making any personal accusations against the judge or her family, nor is he questioning the qualifications of her children. The issue is solely about the potential doubts regarding the fairness of justice in such circumstances.

He further stated that many judges in the country’s judicial history have distanced themselves from cases or requested transfers under similar situations to maintain public trust in the justice system.

Sisodia expressed his primary concern about whether he can honestly remain part of this process when he harbors doubts about its fairness.

He acknowledged that this decision may lead to legal repercussions for him, but he referenced Mahatma Gandhi’s principle of satyagraha, stating that sometimes one must choose between convenience and conscience.

Sisodia clarified that his decision is limited to this specific case and does not indicate a lack of trust in the entire judiciary. He affirmed his unwavering faith in the Constitution and the courts, but noted that the circumstances here are unique.

Meanwhile, Aam Aadmi Party leader Anurag Dhanda also reacted on ‘X’, stating that after Arvind Kejriwal, now Manish Sisodia has chosen the path of satyagraha. He claimed that Sisodia’s letter indicates that the future of the judge’s children lies in the hands of Tushar Mehta, hence fair justice cannot be expected.
