Kejriwal Expresses Disappointment in Justice Swarnakanta, Opts Out of Court Proceedings

New Delhi, April 27: Former Delhi Chief Minister Arvind Kejriwal has made a significant decision by writing a letter to Justice Swarnakanta. He expressed that he no longer expects justice from her, stating that he will neither appear in court himself nor send his lawyer.

In his letter, Kejriwal clarified that this decision comes from listening to his conscience. He referenced Mahatma Gandhi’s principles of Satyagraha, indicating that he will now pursue a path of moral and ideological opposition instead of a legal battle.

Kejriwal also emphasized that this move is not against the judicial system but in support of his principles. However, he made it clear that if Justice Swarnakanta delivers a ruling, he reserves the right to appeal to the Supreme Court.

It is noteworthy that on April 20, Justice Swarnakanta Sharma of the Delhi High Court dismissed Kejriwal’s petition, in which he sought her recusal from hearing the Delhi excise policy case.

While announcing her decision, Justice Sharma stated that withdrawing from the hearing without considering the petition would have been an easy option. However, she prioritized institutional integrity and dignity, deeming it appropriate to decide based on the merits of the case.

She noted that when she began reading her judgment, there was complete silence in the courtroom. Justice Sharma further remarked that this was not merely a legal question but a challenge that put both the judge and the judicial institution to the test.

The Delhi High Court reiterated that a judge’s impartiality is presumed unless proven otherwise by solid evidence. A judge cannot be recused based solely on a party’s apprehensions or personal beliefs.

Justice Sharma stated that no party should be allowed to create a situation that undermines the judicial process. Lies, whether repeated in court or on social media, do not become truth.

In response to the allegations made by Kejriwal, the judge pointed out that there is no evidence to substantiate claims of bias, including accusations related to her participation in events organized by the Bar Council or the professional engagements of her family members.
