High Court Clears Way for 100-Ft Road from Jaipur Airport to Haldighati Circle

Jaipur, October 13 (Daily Kiran): The Rajasthan High Court has given the green signal for the construction of the 100-feet-wide road connecting Jaipur Airport to Haldighati Circle in Pratap Nagar, directing that the project be carried out as per the 2011 sector plan alignment.

A division bench of Acting Chief Justice Sanjeev Prakash Sharma and Justice Sandeep Purohit issued the order while hearing petitions filed by the Ajay Marg Nirman Sangharsh Samiti and others. The court clarified that the Jaipur Development Authority (JDA) must construct the road strictly according to the approved 2011 alignment.

Government to Bear Cost If Agencies Fail to Pay

The court stated that the portion of the road falling under the Rajasthan Housing Board and Jaipur Municipal Corporation jurisdictions will be funded by these respective bodies. However, if they fail to bear the expenses, the state government must undertake the construction at its own cost. The court emphasized that financial constraints must not delay or halt the road construction.

The High Court also directed the state government to monitor the progress of the project. If required, police assistance may be sought during the construction to ensure smooth execution.

Unified Legal Status and No Fresh Claims Allowed

Importantly, the bench ruled that any stay order issued by other courts or tribunals concerning this project will be deemed merged with this order, and no new legal claims or objections will be entertained regarding the road’s construction.

Background of the Case

Petitioners argued that the 100-feet-wide road shown in the 2011 sector plan had not been developed due to encroachments on government land, which also hindered the development of Housing Board Sectors 1 and 2.

On the other hand, homeowners affected by the 2018 alignment modification, represented by Advocate Prahlad Sharma, contended that they had lawfully purchased plots and been residing there for years, but the revised alignment had put their properties at risk of demolition.

Earlier, the High Court had summoned the Principal Secretary, Urban Development and Housing (UDH) to present the government’s plan for resolving the dispute between JDA and the Housing Board, which had differing opinions on the project’s execution.

With this ruling, the long-pending Airport-to-Haldighati Circle 100-ft road project is now expected to move forward under direct government supervision.
