
Noida, March 26: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has introduced the 10th amendment to its general regulations of 2019, aimed at enhancing transparency in the real estate sector and protecting consumer interests. This amendment became effective on March 25, 2026. The changes are considered significant steps towards providing relief to home buyers and ensuring accountability among developers.
Under this amendment, crucial modifications have been made to Regulations 24 and 47. The most notable benefit will be for buyers who have invested in projects that are not registered with RERA. A long-standing question had been whether occupants of unregistered projects could file complaints under RERA. This amendment clarifies that situation entirely.
According to the new provisions, cases related to unregistered projects will now be heard according to the procedures established by UP RERA’s benches. Initially, it will be determined whether the project is exempt from registration. If registration is deemed necessary, the case will be forwarded to the secretary for necessary action. Only after this will a decision be made based on the merits of the complaint, providing appropriate relief to the buyer.
With this system in place, buyers will no longer need to wander aimlessly, as many have faced difficulties in seeking justice until now. Additionally, UP RERA will soon launch a new feature on its portal, allowing affected individuals to easily register their complaints through Form-M.
Furthermore, the amendment to Regulation 47 has provided clear guidelines regarding administrative and processing fees. If an occupant passes away and the property is transferred to a family member, the promoter can charge a maximum fee of only ₹1,000. In cases involving non-family members, this fee is capped at ₹25,000. Moreover, there will be no need to create a new agreement; the existing contract will simply be amended, alleviating any additional financial burden on buyers.
UP RERA Chairman Sanjay Bhusreddy stated that this amendment is a crucial step towards prioritizing transparency, accountability, and consumer interests in the real estate sector. He expressed confidence that this will make the grievance redressal process even more effective and consumer-friendly. This decision by UP RERA is a significant initiative towards resolving long-standing issues, promising direct benefits to thousands of home buyers.
