
New Delhi, July 15: The Supreme Court has declined to hear a petition related to the murder case of Bharat Bhushan Tiwari, a resident of Bilauti village in the Shahpur police station area of Bihar’s Bhojpur district. Justices M.M. Sundresh and Shil Nagoo advised the petitioner to first approach the Patna High Court.
The Supreme Court emphasized that the matter should be addressed at the High Court level. Legal proceedings may only continue if relief is not granted there or if further action is deemed necessary.
The petition was filed by Priya Mishra through advocate Narendra Mishra. It requested that the entire investigation be conducted under the supervision of a committee led by a retired Supreme Court judge. Additionally, the petition sought the registration of an FIR against the accused police officers and action against the officials present during the encounter.
Previously, the Supreme Court had also denied hearing another petition regarding the Bharat Bhushan Tiwari encounter case. This petition, submitted by advocate Vishal Tiwari, alleged that the encounter was staged and called for a CBI investigation. In both instances, the Supreme Court directed the petitioners to first approach the Patna High Court.
Earlier, when the case was mentioned before a bench led by Justice B.V. Nagarathna, the Supreme Court refused to hear it immediately and instructed the petitioner to contact the Supreme Court registry to have the case listed.
This public interest petition seeks an order for an FIR to be registered concerning the encounter death of Bharat Bhushan Tiwari on June 17 in Bhojpur. It also calls for a judicial inquiry under the chairmanship of a former Supreme Court judge and a CBI investigation. According to the petition, deaths resulting from encounters are equivalent to extrajudicial killings and pose a serious threat to the rule of law in a democratic society. Police officers involved in encounters often provide similar justifications, claiming that the deceased attempted to escape, seize weapons, and fire shots, prompting police action.
