Landmark Ruling on Bhojshala: A Historic Decision by Madhya Pradesh High Court

Indore, May 15: The Madhya Pradesh High Court delivered a significant ruling regarding Bhojshala on Friday. The court recognized the Bhojshala complex as a temple. Lawyer Vishnu Shankar Jain spoke to reporters, stating that this historic decision follows the ruling on the Ram Temple, marking a pivotal moment for the judiciary in the country.

Vishnu Shankar Jain noted that a case related to the temples of Maa Saraswati and Maa Vagdevi located in Bhojshala was filed in the Indore High Court in 2022. The petitioner argued that the entire Bhojshala complex is a Hindu temple site, housing the idols of Maa Vagdevi and Maa Saraswati, and has historically been a center for Sanskrit education. Therefore, they claimed a special right to worship at this site.

After a four-year legal battle and a 2100-page survey report from the Archaeological Survey of India (ASI), the Indore High Court made this landmark ruling. The court classified the entire complex as a Hindu temple. Additionally, it urged the government to consider the return of the idol of Maa Saraswati currently held in the British Museum.

Advocate Vishnu Shankar Jain stated that the court completely rejected the Muslim side’s practice of offering prayers every Friday at the site. Until the High Court’s decision is in effect, prayers will not be allowed. The court advised the Muslim community to apply to the government if they seek land for a mosque, which the government would consider.

Jain also mentioned that the ASI notification from April 7, 2003, which permitted prayers at the site, has been entirely dismissed by the High Court. Worship will now take precedence, as the court has annulled the order for prayers. He added that the Jain community’s petition was also rejected by the court.
