
Islamabad, May 17: Questions are being raised about the legitimacy of several representatives elected to Pakistan’s national and provincial assemblies. According to a report from Pakistani media, election tribunals have failed to resolve election petitions within the stipulated time frame.
These tribunals were established to ensure a fair and timely resolution of electoral disputes. A report by Business Recorder highlighted that, according to the Elections Act, tribunals are required to decide on petitions within 180 days. However, as of April 2026, 128 out of 374 petitions remained unresolved.
The report stated that such delays undermine public trust in democratic institutions. It also raises doubts about the validity of decisions made by parliament and assemblies, especially in light of recent significant constitutional changes.
The validity of constitutional amendments relies on the undisputed status of elected representatives. If the legal status of several legislators remains contentious, it is natural to question the moral and political strength of decisions made by parliament.
Furthermore, the report noted that provisions exist in the law to prevent such delays, but relevant authorities have not implemented them effectively. Under the law, repeated requests for extensions can incur penalties. If an elected representative is found to deliberately prolong a case, their assembly membership can be suspended.
According to the Free and Fair Election Network (FAFEN), no member has been suspended to date.
The report also indicated growing concerns over transparency in Punjab, as tribunals have not made documents related to petitions and decisions public. This lack of transparency denies the public, political parties, and independent observers the opportunity to scrutinize tribunal decisions. Such secrecy fosters speculation and further erodes confidence in the impartiality of electoral and judicial institutions.
Similar delays have been observed following multiple general elections, exacerbating political polarization. Tensions persist long after elections conclude.
