Bombay High Court Reserves Order on Rahul Gandhis Defamation Petition

Mumbai, February 25: The Bombay High Court has reserved its decision on a petition filed by Congress leader and Member of Parliament Rahul Gandhi. He sought the dismissal of a criminal defamation proceeding against him.

This case dates back to 2019. On August 28, 2019, Mahesh Hukamchand Shree Shrimali, a member of the Bharatiya Janata Party, lodged a complaint against Gandhi in the Metropolitan Magistrate Court in Girgaum, Mumbai. The complainant alleged that during a public rally in September 2018, Rahul Gandhi made offensive and defamatory statements against Prime Minister Narendra Modi.

Following these statements, various news channels and social media platforms reportedly witnessed trolling and derogatory comments about Modi, for which Rahul Gandhi was held responsible.

Based on this complaint, the magistrate’s court initiated criminal defamation proceedings against Gandhi. Challenging this action, he filed a petition in the Bombay High Court, requesting the case be dismissed on the grounds that his statements were made in a political context and did not constitute a personal attack.

During the hearing of this petition, both parties presented their arguments. After today’s hearing, the court has reserved its order, indicating that it will soon deliver its final ruling on the matter.

According to reports, Gandhi’s lawyers argue that such complaints against political leaders are common in a democracy and should not be used to suppress political discourse. Conversely, the complainant’s side contends that the statements exceeded acceptable limits and harmed the Prime Minister’s image.
