Young Woman Accuses Brother of Serious Misconduct; Jharkhand High Court Questions Police Action

Ranchi, April 2: The Jharkhand High Court summoned the Senior Superintendent of Police (SSP) of Jamshedpur virtually to address a habeas corpus petition filed by a young woman. She questioned why her complaint had not led to the filing of an FIR. The woman alleged that her brother, residing in Australia, used his influence to have her forcibly declared “mentally ill” and admitted to a mental health facility in Ranchi, intending to seize ancestral property.

Justice Sujit Narayan Prasad led the bench and directly asked the SSP why no FIR had been registered despite the victim’s written complaints regarding threats from her brother. The court emphasized that immediate action should be taken on serious allegations. The SSP assured the court that he would review the case and make an appropriate decision.

The victim informed the court that she currently lives in a small rented accommodation in the Kadma police station area of Jamshedpur with her ailing parents, facing severe financial difficulties. She is a highly educated individual preparing for national-level competitive exams. The woman claimed that her brother transferred their grandfather’s property to his name through a “gift deed” and subsequently sold it.

Using his influence, her brother allegedly had her forcibly admitted to the Davis Institute of Psychiatry in Ranchi and later to RINPAS, preventing her from claiming her rightful share of the property. Given the seriousness of the case, the High Court directed that the Secretary of the Ministry of External Affairs be made a respondent to investigate the brother’s whereabouts in Australia.

The bench had previously instructed the Jamshedpur SSP to ensure the safety of the young woman and her parents. The court warned that any untoward incident involving the family would hold the SSP personally responsible. The court also directed the victim’s mother’s lawyer to negotiate settlement points with the brother and submit an affidavit at the next hearing. Advocates Khushboo Kumari and Shailesh Kumar represented the petitioner.
