New Delhi, September 19 (Daily Kiran) : The Supreme Court is now involved in the case concerning the cancellation of Danam Nagender’s membership as a legislator from the Khairatabad constituency in Telangana. This follows a decision by the Telangana High Court. BRS MLA Padi Kaushik Reddy has filed a caveat petition in the Supreme Court.
The caveat requests that if Danam Nagender challenges the High Court’s ruling, Padi Kaushik Reddy’s perspective should be considered before any orders are issued.
Padi Kaushik Reddy was one of the petitioners seeking to declare Danam Nagender ineligible. The other petition was filed by BJP leader Aleti Maheshwar Reddy.
The Telangana High Court had ruled in favor of the petitions, citing the anti-defection law, and subsequently annulled Nagender’s assembly membership. The court overturned a previous decision by the assembly speaker, who had dismissed the request to declare Nagender ineligible.
The petitions alleged that after being elected as an MLA on a BRS ticket, Danam Nagender joined the Congress party and later contested the 2024 Lok Sabha elections as a Congress candidate. The petitioners argued that this action violated the Tenth Schedule of the Constitution and the anti-defection law.
In its ruling, the High Court declared the Khairatabad assembly seat vacant and instructed the assembly speaker and the election commission to take necessary actions.
