Mumbai, March 29: A recent report has revealed that Pakistan, while claiming self-defense in its conflict with Afghanistan, is violating international standards. The findings indicate that Pakistan cannot evade international law regarding its attacks on Afghanistan.
Despite asserting self-defense, Pakistan is unable to escape the strict requirements of international law governing the use of force, particularly within another country’s territory. The report emphasizes the necessity of proportional responses and the clear distinction between military and civilian targets under these regulations.
According to a report by the international magazine ‘The Diplomat,’ there is no principle in international law that permits a country to attack another nation’s territory in pursuit of an alleged security threat, risking civilian areas and later justifying such actions as security measures. If such arguments are accepted, the world could enter a phase where any nation could bomb its neighbors claiming “we have evidence.”
The report highlights that in recent weeks, Pakistan has intensified its airstrikes on Afghanistan, with ordinary citizens, especially children, bearing the brunt of these attacks. The bombing of a drug rehabilitation center in Kabul was particularly shocking, resulting in 143 fatalities and hundreds of injuries, according to the United Nations. This figure represents a humanitarian tragedy of significant proportions.
Citing the United Nations Assistance Mission in Afghanistan (UNAMA), the report notes that three weeks prior to the Kabul rehabilitation center attack, at least 70 people had already been killed in Pakistani strikes, with 478 others injured and approximately 115,000 displaced.
The report further states that there is a deep and troubling silence globally regarding this escalating conflict. While Afghanistan grapples with the harsh and oppressive policies of the Taliban, it also faces cross-border attacks. The Afghan people are suffering from a dual crisis, with their freedom and security being severely compromised both internally and externally.
According to the report, Pakistan’s current stance is not coincidental but rather a result of the long-standing silence and selective accountability of the international community.
It also mentions that since February 28, the world’s attention has been focused on the ongoing conflict between the United States, Israel, and Iran, which has now entered its fourth week. During this time, Iran has targeted countries with U.S. military bases in response to attacks from Israel and the U.S., as well as energy infrastructure in the Gulf region. In this context, Afghanistan has once again been pushed to the sidelines.
The report warns that the international community’s continued silence is not only a failure towards Afghanistan but also promotes a system where criminals go unpunished.
It states that this is normalizing a dangerous precedent where bombings occur in medical centers and civilian areas, yet no concrete action is taken against those responsible because the victims reside in a marginalized country. This poses a threat not only to Afghanistan but to the entire international order. When the fear of punishment dissipates, the law loses its significance.
