Kolkata High Court Rejects Petition Challenging Election Commission Transfers

Kolkata, March 31: The Kolkata High Court has dismissed a public interest litigation (PIL) filed by Kalyan Banerjee, challenging the Election Commission’s orders regarding the transfers of IAS and IPS officers. The Chief Justice’s bench also rejected a petition related to the transfers of the OCC and IC. The court stated that there is no dispute regarding the Election Commission’s authority over these transfers.

Following the announcement of the schedule for the 294-member West Bengal Assembly elections, the Election Commission ordered the transfer of several key officials, including the Chief Secretary, Home Secretary, and DGP. Banerjee filed the PIL against this decision, arguing that such large-scale transfers could harm the state’s governance.

He contended that while the Election Commission has certain powers after the Model Code of Conduct comes into effect, abruptly removing top bureaucrats and police leadership was inappropriate. Such actions could negatively impact the state’s administrative framework.

In contrast, the Election Commission argued that these transfers are essential to ensure free and fair elections and to maintain the neutrality of the administrative machinery. After hearing the case, the bench led by Chief Justice Sujay Paul found no substantial basis for the petition. The court upheld the Election Commission’s constitutional mandate to conduct free and fair elections, affirming the Commission’s right to transfer officials to prevent potential bias or influence.

Sources indicate that TMC MP and lawyer Kalyan Banerjee may approach the Supreme Court to challenge the Kolkata High Court’s ruling.
