
New Delhi, March 14: The Allahabad High Court has dismissed an administrative order limiting the number of individuals allowed to pray in Sambhal district, Uttar Pradesh. Asaduddin Owaisi, the leader of the All India Majlis-e-Ittehadul Muslimeen (AIMIM), welcomed this decision.
Owaisi expressed his approval on the social media platform X, stating, “The Allahabad High Court’s ruling is commendable, rejecting the bizarre orders of the Sambhal police that prohibited prayers on private land. Maintaining law and order is the state’s responsibility. This has become a trend in UP: in one case, individuals were detained for praying inside their homes, and in Sambhal, only 20 people were allowed.”
This ruling comes in response to restrictions imposed on praying on private land, which the petitioner claims is a mosque, during Ramadan. The bench, comprising Justice Atul Srivastava and Justice Siddharth Nandan, reprimanded the administration during the hearing. The petitioner argued that a mosque exists on plot number 291, where many people wish to pray during Ramadan, but local police and administration had limited attendance to just 20 individuals.
The state raised a dispute over ownership, claiming that the land is registered in the names of Mohan Singh and Bhooraj Singh in revenue records. The administration argued that the number was restricted due to concerns over potential law and order issues. The court completely rejected this argument.
The bench stated, “Maintaining law and order is the state’s duty, not that of ordinary citizens. If the SP and collector believe they cannot enforce the law, they should resign or request a transfer from Sambhal.” The court reiterated that state permission is not required for worship on private property, and intervention is only necessary when religious activities occur on public land or affect public property.
The court granted the petitioner an opportunity to submit a supplementary affidavit, which will include photographs of the mosque and revenue records. The case is scheduled for hearing on March 16, 2026.
