
New Delhi, March 10: The Enforcement Directorate (ED) has approached the Delhi High Court seeking the removal of certain comments made by the trial court in the liquor policy case. This case involves former Chief Minister Arvind Kejriwal and other accused linked to a Central Bureau of Investigation (CBI) case, where the trial court had previously acquitted them.
In its petition, the ED argued that the remarks made by the trial court during its order were inappropriate. The agency contended that these comments were recorded without hearing its side and were based solely on conjecture, potentially harming its investigation process and reputation.
The ED has requested the court to strike these remarks from the record, asserting that it was not given a fair opportunity to present its case. The Delhi High Court, presided over by Justice Swarna Kanta Sharma, is scheduled to hear this petition on Tuesday. It is anticipated that the court will decide on further proceedings after hearing the arguments.
This case pertains to the Delhi Excise Policy 2021-22, initiated by the then Aam Aadmi Party-led government, which was later revoked amid allegations of corruption and bribery.
The CBI alleged that the policy was designed to benefit certain private liquor companies, which allegedly paid bribes for electoral purposes, including the South Group. The CBI also claimed that irregularities in the formulation and implementation of the policy led to undue benefits for licensees, resulting in a loss to the government treasury. However, the lower court dismissed the agency’s conspiracy theory, stating that records indicated the policy was developed following proper consultation and deliberation.
