Delhi High Court Grants Interim Bail for Surgery to Murder Accused

New Delhi, February 10: The Delhi High Court has granted interim bail for 45 days to a murder accused to care for his ailing wife and three minor children.

Justice Girish Kathpalia issued the order, stating that the limited duration of bail was requested due to the applicant’s wife needing a surgical procedure for cyst treatment.

Accepting the application, Justice Kathpalia noted that the accused’s wife has custody of their three minor children, and there would be no one to care for them during the surgery.

The Delhi High Court further remarked that despite multiple opportunities, the prosecution failed to submit a status report opposing the interim bail application.

Rejecting arguments that there was no medical emergency and that other relatives could care for the children, Justice Kathpalia found that no written status report was presented to substantiate these claims.

The ruling stated that despite repeated directives, the state did not file a status report detailing the availability of other relatives to care for the accused/applicant’s wife and/or children during the surgery.

Acknowledging the lack of available caregivers for the children, which had previously led to the surgery being postponed, the Delhi High Court deemed the circumstances sufficient to grant interim relief. The order stated, “Considering the above circumstances, the application is accepted, and the accused/applicant is directed to be released on interim bail for 45 days to care for his children and ailing wife.”

Justice Kathpalia instructed that the accused, Furkan alias Faizan, be released upon the satisfaction of the lower court with a personal bond of ₹10,000 and a surety of the same amount.
