
New Delhi, May 18: BJD Rajya Sabha member Sasmit Patra has expressed serious concerns regarding the inadequate infrastructure of the National Company Law Tribunal (NCLT) and the National Company Law Appellate Tribunal (NCLAT) to the central government. He has sent a letter and email to Minister of State for Corporate Affairs Dr. Harsh Malhotra, urging improvements to the current state of these tribunals.
Patra emphasized that the NCLT and NCLAT handle critical matters related to the country’s corporate law framework, the Insolvency and Bankruptcy Code (IBC), and the revival of defunct companies. Despite their importance, these institutions suffer from a severe lack of basic facilities.
He noted that during a recent hearing at the NCLT in New Delhi, there was an unexpected power outage. The situation was so dire that even backup generators were unavailable, causing proceedings to be disrupted for nearly an hour and a half. Patra remarked that if the conditions are this poor in the CGO Complex in the capital, one can only imagine the state of other benches.
The Rajya Sabha member pointed out that many courtrooms are prone to flooding during rains. Some courts can only conduct hearings for half a day due to water leakage issues. He also mentioned that these problems have remained unresolved for over a year.
Patra highlighted that the NCLT is currently operating from rented rooms and MTNL’s leased offices within the CGO Complex. He questioned why a dedicated “Justice Building” cannot be constructed for such essential judicial institutions when modern and grand duty buildings can be built for various central government ministries.
Additionally, he criticized the reliance on contract staff in the tribunals instead of permanent employees, which affects the efficiency of these institutions.
Sasmit Patra has urged the central government to provide robust infrastructure, permanent staff, and modern facilities for the NCLT and NCLAT to strengthen the country’s judicial and economic systems.
