
New Delhi, October 11 (Daily Kiran) : Congress MP Abhishek Manu Singhvi has labeled the detention of protesters as entirely unlawful and unconstitutional. He emphasized that every citizen has the right to peacefully protest in a Gandhian manner, and such actions cannot be suppressed under the guise of special security measures. Singhvi stated that these detentions are preemptive, despite the protesters having committed no wrongdoing.
When questioned about the legality of the detentions, Singhvi responded, “This is completely unlawful and unconstitutional. There is no question of them doing anything wrong. This is purely a preventive measure. It is a total violation of the fundamental right to peacefully protest in a Gandhian way. You cannot do this under the pretext of special security measures.”
He further expressed concerns that these actions are part of a broader campaign aimed at drawing attention to the impact on the foundations of democracy. Regarding the Supreme Court, he noted that there is nothing political about it; it merely presents a specific viewpoint that he believes is essential to the judiciary.
During an event, Singhvi referenced a Supreme Court ruling, stating that Article 121 is not oppressive. He explained that it is a common practice in companies where investors safeguard their interests by requiring a positive vote, effectively a form of veto power. This means no decisions can be made without their consent.
Singhvi highlighted another critical point regarding the six Tata trusts, where two are companies. He clarified that if only one person votes and two do not, the written rules prevent any progress on the matter. He noted that the decision ultimately rests with the active chairperson’s decisive vote, who is not part of the trust or the voting group, illustrating a significant issue within the structure.
