US Senators Accuse Trump Administration of Allowing Advanced AI Technology to Reach China

Washington, June 2: Two senior Democratic senators from the United States have accused the Trump administration of leaving a loophole in American export control regulations. This oversight could potentially allow some of the nation’s most advanced artificial intelligence (AI) chips to reach Chinese companies, which may enhance China’s military capabilities.

Senators Elizabeth Warren from Massachusetts and Andy Kim from New Jersey stated that the failure to update export control regulations over the past 18 months may have inadvertently opened the door for advanced American technology to reach Chinese firms.

In a joint statement, the senators said, “On Sunday afternoon, the Trump administration revealed that the failure to update export control regulations over the last year and a half may have allowed America’s most advanced AI chips to reach Chinese companies, thereby increasing China’s military strength.”

Their criticism follows a move by the U.S. Commerce Department to address a potential loophole in the export restrictions on AI processors, which are produced by companies like Nvidia and AMD.

In its notice, the Bureau of Industry and Security at the Commerce Department stated that licensing rules would apply to those advanced chips exported to companies headquartered in China, even if those companies operate through subsidiaries located outside of China.

Concerns arose that some Chinese companies may have acquired advanced semiconductors through their overseas affiliates, while the U.S. has long sought to limit access to cutting-edge AI technology for China.

Warren, a top Democrat on the Senate Banking Committee, and Kim, a leading Democrat on the National Security and International Trade-Finance Subcommittee, urged the administration to take immediate action to eliminate any ambiguity.

They stated, “The Commerce Department can close this loophole today. It should issue clear and comprehensive guidelines instead of passively watching as American technology reaches the Chinese military.”

Both senators also called for congressional intervention to investigate the management of export control regulations by the Commerce Department.

They added, “Commerce Secretary Howard Lutnick should testify before the Senate Banking Committee and explain how the reckless management by the Bureau of Industry and Security is jeopardizing America’s national security.”
