New Delhi, August 24: The Supreme Court has issued a notice to the Delhi government regarding the bail plea of former legislator and Aam Aadmi Party (AAP) leader Naresh Baliyan. This case is registered under the Maharashtra Control of Organised Crime Act (MCOCA).
A bench comprising Justice Vikram Nath and Justice Sandeep Mehta directed the police to respond to the petition challenging the Delhi High Court’s decision to deny bail to Baliyan. The court has asked the Delhi Police to submit their response within four weeks.
Naresh Baliyan was arrested by the Delhi Police’s Crime Branch on December 4, 2024. He is accused of being linked to an organized crime syndicate run by fugitive gangster Kapil Sangwan, also known as Nandu.
Audio clips have surfaced in which Baliyan allegedly converses with gangster Kapil Sangwan. These clips reportedly indicate a scheme to extort money from builders and others in Delhi through intimidation.
Baliyan is accused of acting as a ‘facilitator’ for Sangwan’s syndicate. He allegedly identified individuals for extortion, forged property agreements, and forced property sales at significantly low prices. On August 3, the Delhi High Court denied him bail.
The High Court stated that in serious cases under special laws like MCOCA, merely spending a long time in jail cannot be the sole reason for granting bail.
However, Baliyan has consistently denied the allegations against him. He described the application of MCOCA as an abuse of law and a manifestation of political vendetta.
