No Constitutional Crisis Arises from Mamata Banerjees Decision Not to Resign, Says Harish Salve

New Delhi, May 5: Former Solicitor General of India and senior lawyer Harish Salve commented on the political situation in West Bengal on Tuesday. He stated that Mamata Banerjee’s refusal to resign from the Chief Minister’s position does not create any constitutional crisis.

In an interview, he explained that even after losing the election, Banerjee’s decision not to step down will not lead to significant constitutional issues, as there are adequate legal provisions to address such situations.

Salve noted that the Governor has the option to allow the current Chief Minister to continue as a caretaker or to advise the central government to impose President’s Rule.

He expressed hope that Banerjee is not planning to create a situation similar to that in the Capitol in Kolkata.

Salve referenced Donald Trump’s actions in 2021, when he incited his supporters to attack the Capitol before resigning after losing the election.

He remarked that over the past decade, a mindset has emerged where people discuss “my truth and your truth” instead of the actual truth. Banerjee calling the Election Commission a “villain” is unfortunate and indicates that some leaders are questioning constitutional institutions, which is an affront to democratic principles.

Salve further stated that a Chief Minister who has sworn to uphold the Constitution is now refusing to do so.

Regarding the fairness of the West Bengal elections, he asserted that they are entirely constitutionally valid, as the Supreme Court has dismissed related petitions.

He also compared Banerjee’s attitude to a recent statement by Arvind Kejriwal, who accused a High Court judge of bias. Such statements are attempts to intimidate institutions, sending a message that if decisions do not favor them, they will investigate the backgrounds of those involved.

It is noteworthy that Banerjee has recently alleged irregularities and “vote theft” in the assembly elections and has refused to resign before the next government takes oath.

She stated to the media, “Why should I resign now? We have not truly lost. The results do not reflect the actual mandate but are outcomes of irregularities and ‘vote theft’.”
