Karnataka HC Lifts Ban on Bike Taxi Services, Ola and Uber Get Major Relief

The Karnataka High Court has lifted the ban on bike taxi services in the state, granting significant relief to app-based companies like Ola and Uber. The court’s ruling now allows the use of bikes as taxis, provided all legal regulations are strictly followed.

A division bench comprising Chief Justice N.V. Anjaria and Justice K.V. Aravind delivered the verdict, overturning a previous single-judge order that had upheld the state government’s ban on bike taxis. Ola, Uber, and other aggregator companies had appealed against the ban, arguing that under the Motor Vehicles Act, bikes can be used for commercial taxi services if the proper permits and licenses are obtained.

The court agreed with these arguments, stating that the law does not prohibit the use of bikes as transport vehicles. It directed that bike owners and aggregator companies must first apply for commercial permits from the transport department. The state government has been instructed to consider such applications in accordance with existing legal provisions and issue permits accordingly. The court also emphasised strict compliance with safety, insurance, and other applicable regulations.

This decision brings relief to millions of passengers and young riders across Bengaluru and the entire Karnataka region. The bike taxi issue had been contentious for several years, with the state government imposing the ban in 2022, which led to legal challenges by the companies involved.

With this development, there is hope for easing Bengaluru’s traffic congestion, as bike taxis can offer a faster and more affordable option for short-distance travel. However, concerns remain regarding safety, especially for women and children. The court has asked the government to frame stringent guidelines for bike taxi operations to minimise accidents and other risks.
