Judge Should Recuse Themselves for Judicial Dignity: Anurag Dhanda

Rohtak, April 21: The Delhi High Court has made a significant ruling regarding the alleged excise policy case involving former Chief Minister Arvind Kejriwal. The court dismissed Kejriwal’s petition, which sought the recusal of Justice Swarn Kanta Sharma from the case. Following this decision, the Aam Aadmi Party (AAP) expressed strong discontent.

AAP’s National Media In-Charge, Anurag Dhanda, stated that this issue has raised questions across the country. Observers of the case have developed various doubts. Kejriwal’s petition highlighted two main concerns. Firstly, it questioned the connections of Justice Swarn Kanta Sharma’s family with a central government panel and the potential benefits arising from it. Secondly, her participation in events organized by groups like the Rashtriya Swayamsevak Sangh was also brought into question. Dhanda emphasized that such facts naturally lead to doubts about the fairness of the proceedings.

He remarked that in such circumstances, it is reasonable for the public to wonder whether a fair decision can be reached. He also noted that in a previous similar case, the judge had voluntarily recused themselves at the request of the investigating agency. He questioned why this precedent was not followed in the current situation.

Emphasizing the dignity of the judiciary, Anurag Dhanda stated that if any party harbors doubts about the judicial process, the concerned judge should voluntarily withdraw from the case to maintain transparency. He asserted that fairness and transparency are the greatest strengths of the judicial system, and there should be no question regarding them.
